1 This Learning Management System (LMS) and its content belongs to the Institution of Occupational Safety and Health (IOSH), The Grange, Highfield Drive, Wigston, Leicestershire, LE18 1NN, UK.
2 This material is covered by copyright and may not be used, sold, copied, modified or reproduced in whole or in part in any manner or form or in any media by any person without the prior written consent of the copyright owner. ‘IOSH’ and the IOSH logo are registered trade marks belonging to IOSH and may not be reproduced without written consent from IOSH.
3 If you don’t agree to abide by these terms, please don’t use this LMS.
4 You may terminate this agreement at any time by logging out and removing all links to the IOSH LMS (including the IOSH content) from your device.
5 Clause 2 shall survive termination of this agreement.
6 Once paid by you, the fees for this course are not refundable.
7 IOSH may update these terms at any time. You should visit this page regularly to review the current terms because they are binding. Continued use of the LMS constitutes your agreement to all such revised website terms.
8 Your right to privacy is very important to us and we know that when you give us information about yourself, you trust us to be responsible with it. We’re committed to protecting the privacy of those using our products and the confidentiality of the personal information that our users give us. We take appropriate technical and organisational security measures to protect your personal information.
9 IOSH is registered under the Data Protection Act 1998 and complies with the Act whenever we handle your personal data.
10 When you use this LMS you will need to enter personally identifiable information such as your name, address, contact details, photo identification and video clips. Any personal information you give to us will only be used by IOSH for the administering of this course product. IOSH doesn’t sell or share personal information with third parties unrelated to it.
11 The LMS should operate as expected on your device. IOSH will not be liable for any data loss suffered by the failure of the LMS on all, or part, of the device however it is caused.
12 While the information contained in the LMS has been compiled from sources believed to be current and reliable, IOSH makes no warranties about the accuracy, reliability, completeness or timeliness of such information and will not be liable for any loss or damage suffered from any error or omission which may occur.
13 The contents of the LMS don’t constitute advice, and reliance upon such content is entirely at the user’s own risk.
14 Content will need to be uploaded to the LMS by you. IOSH makes no warranties and accepts no liability for such material.
15 IOSH shall not be liable for any damages arising from the use of, or inability to use, the LMS or any of its contents. Whilst precautions are taken, IOSH does not guarantee that the LMS is free of infection by viruses or anything else that may be harmful or destructive. If use of the LMS results in the need for servicing or replacement of equipment or data, IOSH is not responsible for those costs.
16 IOSH will, upon notification, consider removing any material open to legal objection while it is being investigated.
17 Unless expressly stated otherwise, all information contained in the LMS is owned or licensed by IOSH. The information and content contained on the LMS, such as text, graphics, images and other such material (“Material”), are protected (without limitation) by copyright, database rights, registered trade marks, passing-off rights or rights protected under unfair competition laws, all of which may be protected under both English and foreign laws (“Intellectual Property Rights”). Unauthorised use of the Material by you may violate IOSH’s Intellectual Property Rights.
18 Where IOSH publishes content on behalf of, or written by, a third party (for example another Association), all responsibility for accuracy and liability of that content belongs to the third party.
19 This LMS may provide links to websites that are not under the control of the Institution. IOSH does not accept any responsibility or liability for the privacy policies, content or practices of these websites. If you decide to access linked third-party websites, you do so at your own risk. Unless specifically stated otherwise, IOSH does not endorse any of the products or services advertised or available on any of the sites it links to. The law set out in non-UK websites may not be the same as the law in the UK legislation.
20 IOSH cannot accept any responsibility for information on websites that we don’t manage but which may refer to IOSH.
21 You hereby agree to indemnify IOSH in respect of all damages, costs and expenses, including reasonable legal fees and litigation expenses, resulting from any use by you of the IOSH LMS (including IOSH content) in breach of these terms.
22 Neither party may assign, charge, sublicense or otherwise deal with its rights or obligations in this agreement in whole or in part to any third party.
23 Any failure or delay by either party in exercising its rights under any provisions of this agreement shall not be construed as a waiver of those rights at any time now or in the future.
24 This agreement shall be governed by, construed and take effect in accordance with English law and the English courts shall have exclusive jurisdiction to settle any claim or dispute which may arise in connection with this agreement.
25 IOSH aims to ensure our LMS complies with English law but not the laws of any other country. If there is anything on the LMS that you are not allowed under the laws to which you are subject to access or see, please stop using the LMS immediately.
